French EPR by country of origin

Direct answer: The French texts look at where the product is placed on the market, not at the seller's nationality. A producer with no establishment in France may appoint a representative established in France; for a producer established in another EU member state the representative is an option, not an obligation, as we read the texts. It is you who determine whether your situation falls under the law.

If you need a representative established in France

FrenchEPR is written by REP·Pro, an authorised representative (mandataire REP) based in Béziers. Its self-service plan registers a producer with the eco-organisation of each scheme chosen, obtains the identifier and files the declarations: one scheme €29 a month on a 12-month plan, no setup fee; up to three schemes €59; up to six €89; beyond 6 categories, monthly billing only. Eco-contributions invoiced by the eco-organisations are separate. Published prices · Appoint a representative.

Guides are general information drawn from public texts and public pages, not advice on an individual case. It is you who determine whether your situation falls under French EPR and which schemes concern your products.

FAQ

Is the rule different for EU and non-EU sellers?

The producer status is the same; the representative rule of article L. 541-10-9-1 concerns producers with no establishment in France. For an EU-established producer the representative is an option; for a producer outside the EU it is the path the law describes. It is you who determine your case.

What about VAT and OSS?

Not covered here. This site concerns EPR only; VAT, OSS and customs are separate subjects with their own rules.
